TERMS AND CONDITIONS

Please also read carefully our booking conditions below that relate to your booking.  By asking us to confirm your booking, you are liable to be regarded as having had the opportunity to do so.  The booking conditions form the basis of our contract with you.  

A binding contract between us comes into existence once you receive confirmation of our acceptance of your booking. In these Booking Conditions, ‘you’ and ‘your’ means all persons named on the booking (including anyone who is added or substituted at a later date). ‘We’, ‘us’ ‘our’ and ‘ourselves’ means Surf Taghazout Surf Travel Holidays

 

The following Terms & Conditions, together with the General Information

contained on our website form the basis of your contract with us.  Please read them carefully as they apply to any booking made with us. Please ensure that you have read and understood the following Terms & Conditions before filling in the booking request form.

 

 

YOUR CONTRACT

Your holiday contract is made with Surf Taghazout. When making a booking, you guarantee that you have the authority to accept and do accept the terms and conditions layout out in these booking conditions. When we are acting as the agent of another principal, you also confirm that you accept the terms and conditions of that principal (i.e. another tour operator).

 

These booking conditions form part of that contract with us. A binding contract between us comes into existence once you receive confirmation of our acceptance of your booking. Any changes to these Booking Conditions will only be valid if agreed by one of our company Directors.

 

MAKING YOUR BOOKING

To confirm a booking, the authorized party leader must complete and sign our booking form or otherwise confirm verbally or in writing that a booking is being placed with us. The party leader must be authorized to act on behalf of all persons named in the booking, including any persons under 18, and is responsible for all necessary payments in relation to the booking.

 A deposit or full payment (specified at time of booking) is required in order to proceed with confirming your booking with us. All bookings are subject to availability. Once arrangements have been confirmed by us, a confirmation invoice will be sent to the party leader. It is important that this confirmation is checked upon receipt in order to ensure all information is correct and complete. You are required to notify us immediately should any information on your confirmation invoice appear incorrect. We regret that should you fail to notify us within 14 days of the dated confirmation we cannot accept liability for any amendments required, unless the error was made by ourselves.

 

PAYMENT TERMS

In order to confirm your travel arrangements, a deposit of 25% of the total holiday cost, or a minimum of Euro 100, which ever is greater must be paid at the time of booking. The balance is required at the latest, 60 days prior to departure.

For any bookings made within 60 of departure, full payment is required at the time of booking. No payment will be processed until all arrangements have been confirmed with our suppliers unless otherwise agreed between both parties. Should a higher deposit be required, this will be advised at the time of

booking. It is your responsibility to ensure that all payments are made within the due time, as we do not send payment reminders.

 

Failure to pay in full by the required date may result in the cancellation of your booking by ourselves and the loss of your deposit. Should there be a subsequent agreement to extend the final payment due date, we reserve the right to charge a

cancellation fee in accordance with our cancellation policy specified below.

 

SURCHARGES

A surcharge of 3% will be levied for payments made by Credit Card.

 

WEBSITE ACCURACY

The information contained on our website is correct to the best of our knowledge and we always endeavour to provide up to date images and information. We do not accept liability for any errors contained on the website. Prices advertised on our website are indicative only and are provided to guide you as to the approximate and relative costs of different holiday arrangements. A final holiday price will be provided to you as a quotation either verbally or in writing.

 

AMENDMENTS/ CHANGES BY YOU

Should you wish to make any amendments/ changes to your issued and confirmed booking, you must notify us in writing as soon as possible.

Whilst we will endeavor to assist, we cannot guarantee we will be able to meet any such requests. Any changes to your booking made after the receipt of your confirmation invoice will be considered as amendments. Where we are able to

make amendments for you, an amendment fee of Euro 25 per person will be payable together with any costs incurred by ourselves and any costs or charges incurred or imposed by any of our suppliers. If you wish to make any amendments after full payment has already been received, this will be considered as a cancellation and full cancellation fees will apply. Please ensure that all passenger names are checked thoroughly on your confirmation and that they match the name on the passenger’s passport.

 

CANCELLATION BY YOU

Should you or any member of your party need to cancel your booking after confirmation has been issued, the party leader must advise us in writing immediately. Your notice of cancellation will only be effective upon receipt once received by us in writing. As we incur costs from the time we confirm your booking, the following cancellation charges will be payable.

 

Where the cancellation charge is shown as a percentage, this is calculated on the basis of the total cost payable by the person(s) cancelling excluding any amendment fees. Amendment fees are not refundable in the event of cancellation.

 

Cancellation period and applicable fees are outlined below:

TRANSFER OF BOOKING

It may be possible for you to transfer your booking to another party. An amendment fee of E25 pp will apply, plus any charges levied by the supplier.

 

CANCELLATION BY US

We reserve the right in any circumstances to cancel your booking for any reason. This will normally only be due to circumstances beyond our control. If we do cancel the booking, an alternative booking of similar standard will be offered to you subject to availability. If this is not acceptable, any monies paid by you to us will be refunded. We do not accept any liability for any loss or damage arising out of any cancellation on any account whatsoever.

 

LIMITATION OF LIABILITY/DISCLAIMER  

We shall not be liable for any loss or damage to you or your property arising from any matter or circum¬stances beyond our reasonable control including (but not limited to) Acts of God, war, civil disturbances, strikes or other industrial action, acts of government, acts of third parties, activities on adjoining land including building works or failure of public supplies including (but not limited to) electricity and water. Nothing in these conditions excludes or limits our liability to you for death or personal injury caused by our negligence; under the Consumer Protection Act 1987; for any matter which it would be illegal for us to exclude or attempt to exclude our liability; or for fraud or fraudulent misrepresentation. Other than claims for death or personal injury, and subject to the above, our total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise arising in connection with the performance or contemplated performance of a booking shall be limited to the price of the booking, and we shall not be liable to you for any other direct, indirect, consequential losses or other claims for additional compensation.

 

COMPLAINTS

If you have a complaint or problem about any of your booking you must bring it to the attention of ground handler and/or the supplier immediately at the time so that they may use their best endeavours to rectify the situation whithout delay. It is only if ground handler and/or the supplier immediately is made aware of any problems that there will be the opportunity to put things right. Should the problem remain unsolved a complaint must be made in writing giving full details of your complaint within 28 days of the end of the booking period We will only act upon complaints lodged by you with the ground handler/ supplier during the booking period. We regret we cannot accept liability in relation to any complaint, which is not brought to our attention entirely in accordance with this condition.

 

CONDUCT OF MISBEHAVIOUR

We reserve the right at our absolute discretion to terminate without notice the booking for any client/party member whose behaviour is such that it is likely in our opinion to cause distress, damage or annoyance to our customers, employees, property or to any third party. Full cancellation charges will apply and we will be under no obligation whatsoever to provide a refund or compensation for costs which may be incurred. Upon such termina¬tion our responsibility to you and your booking ceases and we shall not be liable for any costs incurred by you or any member of your party.

 

ACTIVITIES

Your booking is accepted on the understanding that you realise and accept the risks and hazards potentially involved in activity holidays and that you are mentally and physically capable of undertaking your chosen activity/holiday/trip. The client/guest acknowledges that the nature of the tour is adventurous and may involve a significant amount risk to both people and property. The client/guest hereby assumes all such risk and does hereby release us from all claims and causes of action arising from any damages or injuries or death resulting from these inherent risks. It is your responsibility to ensure that you are fit to travel and participate in all of the services, activities, and facilities you have booked to undertake.  All clients must inform us in writing (at the time of booking) of any medical conditions, illnesses or allergies. Anybody with a heart condition, or is pregnant, or under the influence of any alcohol, drugs or medicine which may adversely affect their physical abilities must not and may not be allowed to participate in any of the activities under any circumstances.  If, in our reasonable opinion, your chosen activity/holiday/trip is not suitable for your medical condition or disability we reserve the right to refuse your booking. We reserve the right to cancel the contract if medical problems are discovered, in this eventuality we will give a full refund but no compensation. All partici¬pants must agree to abide by all instruction and all decisions made by the instructors to ensure their safety. All of the activities are dependent on weather and other factors. If in the interest of safety the activities cannot be pursued we cannot be held responsible. Damage to any equipment must be reported to the ground handler/ supplier immediately.

 

TRAVEL INSURANCE

All clients must be covered by adequate travel insurance valid for the full duration of the holiday. We will not be responsible or liable for any injury or damages suffered or incurred in any way arising from or occurring during your duration of the holiday. Comprehensive travel insurance (including medical and repatriation cover) is compulsory. In addition, all clients participating in a boardriding activity must have a travel insurance policy that covers each activity undertaken.

 

VACCINATIONS AND HEALTH

It is your responsibility to ensure that you are fit to travel and participate in all of the services, activities, and facilities you have booked to undertake. It is also your responsibility to ensure that you have any necessary vaccinations for your travel arrangements and are able to prove that you have the relevant vaccinations. Consult your doctor about any health requirements for all destinations to which you are traveling. We are not liable if you are refused entry to any country or part of a country because you do not have or cannot prove that you have the necessary vaccinations or do not comply in any way with the health requirements of your destinations.

 

PASSPORTS AND VISAS

You will require a valid passport for your journey, with at least 6 months validity remaining, for entry into most countries. Visas are the responsibility of each person traveling. It is solely your responsibility to ensure that you are in possession of the necessary documentation to comply with the laws and regulations of the countries to be visited.
